In Ukraine, Tetra Tech implements the USAID Energy Security Project (ESP), a seven-year project funded by the United States Agency for International Development (USAID) and the largest USAID project in Ukraine so far. USAID ESP’s mission is to enhance Ukraine’s energy security, improve the energy legal and regulatory environment, and bolster energy supply resilience to support economic development and sustain Ukraine’s democracy. Tetra Tech is working closely with the Government of Ukraine to develop competitive energy markets and facilitate private sector-led energy investments to provide affordable, reliable, resilient, and secure energy for all Ukrainians. This project is expected to run through June 2025.

Tetra Tech has an opportunity for a Regulatory & Legal Specialist/Expert who will assist with development of the EU acquis-compliant regulatory and legislative framework in Ukraine. This includes the transposition of relevant EU directives and regulations that are most relevant to the electricity and gas markets, EU REMIT implementation, energy market integration with Europe, and competitive market development. An important part of the work will be the day-to-day interface with the relevant ministries (especially the Ministry of Economy), National Energy and Utilities Regulatory Commission (NEURC), Government Office for Coordination of European Integration (GOCEEI), National Securities and Stock Market Commission (NSSMC), the Anti-Monopoly Committee of Ukraine (AMCU), and other relevant stakeholders to achieve ESP objectives. The Regulatory & Legal Specialist/Expert will also assist the Energy Market & Institutional/Regulatory Advisor with circulation of reports, documents, and meeting minutes as required by ESP. This is a full-time position for the period of one year with the possibility of an extension for another term. This position is based in our Kyiv office. Learn more about ESP here.

Position responsibilities

  1. Facilitate an in-depth analysis of the relevant EU acquis including, but not limited to, Electricity Market Directive 2019/944 and Regulation 2019/943; Regulations 2019/941 on Risk-Preparedness and 2019/942 on ACER; EU Gas Market Directive 73/2009; as well as the EU Regulations 1227/2011, 1348/2014, 2015/1222, 2016/1719, 2017/2195, 2017/2196, and 2017/1485, among others, especially in terms of their guiding objectives, goals, and rules.
  2. Identify the potential issues with Ukrainian legislation related to the application and implementation of EU acquis-compliant solutions and rules and develop ways to address these issues.
  3. Draft and develop the necessary material, presentations, and EU acquis-compliant pieces and provisions of relevant legislative proposals.
  4. Attend any relevant public consultations and hearings devoted to the development, presentation, and discussion of relevant legislative proposals.
  5. Assist the Energy Market & Institutional/Regulatory Advisor in circulating reports, meeting minutes, and other documents required under ESP. 

 

Minimum Qualifications 

  • A master’s degree or equivalent in economics, energy, engineering, finance, legal, and/or other related fields.
  • Experience working in an international environment, especially supporting USAID- or other donor-funded projects, law offices, and/or companies in Ukraine.
  • Working experience with the conceptual development and drafting of legislation and sectoral reform frameworks.
  • Experience supporting the electricity and gas sector regulators, ministries, or relevant energy institutions and operators (companies).
  • Knowledge of the EU legislation mentioned above.
  • Professional proficiency in speaking and writing English and Ukrainian.
  • Proficiency in MS Office applications (MS Word, Outlook, Excel, PowerPoint).

Physical demands & work environment 

  • Possible occasional business travel.
